What is a Will?
A Will is the document by which individuals make a disposition of their property, to take effect at death. A Will can be changed and is revocable during one's lifetime.

What must be included in a Will?
A Will typically contains the following items:

  • A formal declaration that this is my Will, and a revocation of all previous Wills
  • Designation and Authorization of Personal Representative.
  • A formal declaration of Will and a revocation of directions for specific gifts, if any
  • Directions for distribution of residue of estate
  • Miscellaneous provisions

What is a Living Will?
A Living Will is a document that provides precise medical instructions for the agent under a medical power of attorney. Absent precise instructions, the Living Will basically states: “If the situation should arise in which there is no reasonable expectation of my recovery from physical or mental disability, I request that I be allowed to die and not be kept alive by heroic measures or artificial means.”
